Kindly ensure that you refer to this document before every use of our website will.cfocorp.in. These terms are liable to be changed by us periodically and without prior notice of the same. These will come into effect immediately upon publication of the same.

Your access to this website is conditional upon your acceptance of the terms stated herein. The use of our website by you will be seen as an acceptance of the rules and terms stated in this document. It will also be held as proof of your understanding of the entire document and every clause mentioned herein.

Your acceptance of this document signifies your acknowledgment and acceptance of the admissibility of this document and any electronic communication with CFOCORP in any legal proceeding that may arise in a competent court under this agreement with regards to your use of the website, and shall have the same value as that of any other printed documents.

We offer services like Financial Support and Advisory Services, Stressed Assets Management, Regulatory Compliances and Business Support.

This website offers a wide range of services under the Succession laws in India. We offer help to prepare Wills in accordance with the requisite laws in force and provide ancillary support to achieve this goal of our users. We are also providers of information pertaining to the above-mentioned services to the best of our knowledge and expertise.

We are not a law firm or members of the Bar Council of India. However, our team consists of experienced lawyers who are registered with the Bar Council of India. 

We have curated services that are accessible to you through your computer or mobile device. Our online services provide you with an automated model which allows you to fill in the information for your personalised Wills according to the Succession laws, and we also offer several personalized offline services. These services include a step-by-step guidance wherever required, assistance, execution and preparation as well as attestation of any and all documents required under these services. Depending upon the city of your residence or business, we also provide services for the offline registration and notarisation of Wills (in select states). We can also recommend other lawyers/ law firms/ corporate bodies to help assist you in any allied functions related to succession planning, including the appointment of executors/ trustees for your Wills. Although we provide guidance in the execution of legal documents, this does not constitute any legal, tax or financial advice. You are advised to consult an advocate for any confirmation regarding your legal documents.

During the use of this website, you are subjected to these terms and any other guidelines or rules that may apply to any media or service included in this website. These are guidelines that are compulsory to be followed. They will be changed and/or updated from time to time. These guidelines are incorporated in these Terms of Use.

We reserve the right to amend, change, modify, remove and otherwise alter these guidelines in any way whatsoever without prior notice of the same. Therefore, you are advised to refer to these Terms from time to time, preferably every time you use this website. Your use of this website after the change in these terms will signify your acceptance of those changes. The changes made to these terms will come into effect immediately after they are posted on this site. Kindly also refer to any additional terms and conditions or guidelines that any of our business partners/ collaborators/ referrals etc. may mention on their own website or application. Any new link you visit through our website may be subject to a different set of terms and conditions or terms of use and CFOCORP shall not be responsible for any breach in those terms by any of our users or customers.

Any of the links/ media/ services etc. available on this website may be altered, changed, modified or removed without prior notice at any time. The links provided may not be updated to the newest version. Any links/ media/ services etc. may be temporarily unavailable on our website. We ask for your patience at such a time. However, we do not take responsibility for any such delays/ cancellations/ problems in working of any functions. We also cannot make any commitments as to the frequent updating of any services/ information available on the website.

Eligibility for the use of the website:

By agreeing to these terms, you state that you are of legal age, that is, at least 18 years of age, you are competent to enter into a contract under the provisions of the Indian Contract Act, 1872. If you are not of legal age, you confirm that you are under parental or guardian supervision while using this website. You confirm that you are not forbidden by any law in force to visit our website and contract any services we may provide, and that you are not violating any law in force in India. You also promise that all information you enter on our website is true and accurate to the best of your knowledge.

Requirements to access our website:

  1. a) You are required to create an account on our website. You will need to create a username and password. Kindly ensure this password is strong and unique to you. Kindly never disclose this password to anyone. In case you forget your password or your password is compromised, kindly follow the steps mentioned on the website to choose a new password. This password is unique to you and is not accessible by us via our system, hence you are advised to note this password correctly as we will be unable to retrieve it. You alone will be responsible for any misuse of your login credentials. In case of any misuse, you may contact us at contact@cfocorp.in and report your concern or immediately change your password as stated above.
  2. b) While creating an account, you agree that you are above 18 years of age or have parental/ guardian supervision. You agree that you have read the Privacy Policy, Disclaimer, Refund Policy, this Terms of Use and any other relevant guidelines or policies which may be applicable and available on our website. You also promise that all information you enter on our website is true and accurate to the best of your knowledge. You promise to update the information mentioned in your account from time to time whenever it becomes prudent.
  3. c) CFOCORP reserves the right to suspend or cancel any user’s account at our own discretion. We may take any necessary action if a user impersonates another person, provides false information to us, copies any personal details of another user etc.
  4. d) We reserve the right to decline your registration of an account as well as delete your account without due notice (except notice as applicable under any law in force). We reserve the right to suspend or delete your account if you violate any rules/ guidelines/ regulations/ terms etc. mentioned on our website or any laws applicable in India.
  5. e) CFOCORP will not be responsible for any damages or losses, monetary or otherwise, as a result of the suspension/ revocation/ termination of your existing account or the cancellation of your request to create an account on our website.

Website Services:

  1. a) The services we provide on this website deal with the drafting of a DIY Will, among other things. This Will is for the benefit of a layman and considers ordinary or general circumstances while setting out clauses in the said Will. We are unable to foresee any and all complexities that could result in the drafting of a Will based on your personalized experiences. We have strived to create a Will that is simple and accessible to any and all common people without providing for complexities with respect to the asset and liability distributions based on your personal family history. This DIY service is only curated keeping in mind simple Will drafts that any person can utilise when planning for their wealth distribution. The DIY Will service requires personal details regarding the testator in order to create a legally sound Will under the applicable laws in India. This could include details such as contact numbers, email addresses, residence, religion, gender, etc. In order to understand how we utilise such personal data, kindly refer to the Privacy Policy available on our website.
  2. b) In case your personal Will requirements are more complex than a simple DIY Will, you can utilise other services that you can find on our website, or you can contact us for the same through the specified contact details available on our website.
  3. c) The user will have the option of selecting whichever DIY service they require, and upon due payment as mentioned on the website, the user will have access to the DIY service. The user will be required to fill the relevant details prompted in the DIY Will. After the completion of this process, the draft Will would be completed. The user will receive a Word and/ or PDF file via email or courier services (as specified during the payment process).
  4. d) When creating a DIY Will, you are advised to contact our team in the event you do not understand any clause or option mentioned in the document or you are confused about the process/ end result/ categories etc.
  5. e) If you do not seek professional legal advice while drafting or registering the Will, you agree to take full responsibility of any damages or losses, monetary or otherwise, that may arise from those circumstances. You are advised to perform your own due diligence and seek professional legal help while undertaking the process of Will drafting.
  6. f) You are requested to abide by the specific format mentioned in the DIY Will software on the website while providing any and all information requested from you. Any information entered that does not conform to the set format will not be accepted by the system and the DIY Will may not be completed.
  7. g) The DIY Will contains both optional and mandatory fields while drafting the Will. You are obligated to provide all the information in the mandatory fields. It is, however, up to your discretion to provide any and all information requested in the optional fields. The optional and mandatory fields will be distinguished with the usage of the “asterisk” sign (*), with the mandatory fields being marked with the asterisk sign (*).
  8. h) You may change/ amend your draft Will any number of times for a period of _______ days till you mark the process as completed and request a final copy of your finished Will. Therefore, you are eligible to receive only ONE finished copy of the Will via email or courier services (as specified during the payment process). You may make any desired changes for the above-specified period till you request your final copy.
  9. i) After the completion of ______ days, if you have not generated your final copy of the Will, the payment that you made (according to the service you selected) will lapse. CFOCORP will not be liable to grant a payback to the customer for any reason whatsoever. We do not retain any information that is provided in the DIY Will, therefore, we will be unable to provide you any details with respect to the details you filled in the DIY Will. If upon making payment for a service, there seem to be some technical issues which lead to non-reflection of the payment, you should contact our team at the earliest. We will solve the glitch or give you a refund as soon as possible.
  10. j) Before generating the final draft of the Will, you will be provided with a preview of the draft Will. You are requested to double-check all the information in the preview as this is the exact final copy you will be provided after generating the Will. In case there are any discrepancies with the preview, you will have the option to edit the document and change/ modify/ remove any information or clauses that you want. We will not be responsible for any mistakes in the final draft as this is an automatic system. Therefore, to reiterate, kindly double-check the preview for any mistakes or changes before generating the final copy. You can contact our team for any questions or doubts you may have regarding this process.

Partners:

  1. a) CFOCORP may partner with any law firms/ advocates/ advisers/ institutions/ body corporates etc. according to our discretion. 
  2. b) We may provide links to our affiliate institutions via our website. The names of our partners and any services they offer will be displayed on our website and in any links that are provided.
  3. c) You may visit these links to view the services that are provided. Kindly check that these links are authorised and provided through our website before making any payment or posting any personal information on these links. If you suspect that the link you visited may be unauthorised or is posing as some authorised affiliate, you are requested to inform us as soon as possible upon this discovery. This will help us take necessary action instantaneously. 
  4. d) Although we take all prudent measures to ensure the safety and security of such links posted on our website, CFOCORP cannot take any responsibility for any losses or damages that may occur due to your visit to such links. You are therefore requested to perform due diligence before volunteering information to third-party sites.
  5. e) For information regarding the storage and utilisation of your data by third-party affiliates, you are requested to refer to our Privacy Policy displayed on this website.
  6. f) If any consumers have contracted our services through any of our partners’ affiliate links, the customers will be subject to these present terms of use and any such guidelines/ regulations that we have displayed on our website. Our partners shall not be a party to these transactions and the contract will be between CFOCORP and the consumer only.
  7. h) It is our sole discretion to provide any customers with services mentioned on our website or any such offline services that we may provide. Our partners shall not have any discretion in determining whether CFOCORP will provide such customers with services. We are not obligated to accept any customers that visit us through these affiliate links or directly. We shall not provide customers with any such services which may be contrary to any existing laws in force or against our Terms of Use. 
  8. i) We may have a financial and monetary agreement to provide our partners with certain payments for their affiliation with our website. These transactions are solely between CFOCORP and such affiliate partners that we have agreed to enter into a partnership with. The customer shall not be a party to these transactions. You also consent to the payment of such incentives to our partners.

Other services:

Apart from DIY Wills, we also provide other services, both online and offline.

  1. a) We help prepare and execute personalised Wills suited to your particular needs and any other documents under the Succession laws in India.
  2. b) We help guide you to execute, attest, store, modify, translate etc. any documents pertaining to succession planning, especially Wills.
  3. c) We can recommend legal professionals/ law firms/ corporates etc. who will aide you in the registration/ attestation/ notarizing etc. of your Will in select states and cities.
  4. d) We can undertake/ recommend legal professionals/ law firms/ corporates etc. for custodian and executor services.
  5. e) In order to avail the services mentioned on the website, kindly get in touch with us in the manner provided for on the website. We will get back to you as soon as possible.

Payment process:

  1. a) The online services on the website accept online payment for the services availed. The payment methods available on our website are stated when you go ahead with the payment process. The site leads to a secure payment gateway. You can select the manner of payment through our website, which includes, but is not limited to, credit/ debit cards, UPI, Net banking, etc.
  2. b) We reserve the right to charge and recover the amount you have paid through the payment gateway. 
  3. c) All services on the website will attract due service tax, as applicable under the Finance Act.
  4. b) For the offline services, we accept card payments in our office, or NEFT/ cheques/ demand drafts etc. for remote payment. However, your access to any services is subject to the payments being credited to us. In case your cheque does not clear, you will have ______ days to make a repayment, failing which we will withdraw any services already provided or in the process of being provided. Our contract of service will become void for lack of payment.

Protection of Privacy:

  1. a) CFOCORP is 100% committed to protecting our users’ data and maintaining strict confidentiality. We respect all the information provided to us by our customers and we strive to maintain that trust.
  2. b) We have made the password of your account accessible only to you. No one, including at CFOCORP, will have access to your account except you. We have also provided you with the ability to change your password whenever you find it prudent, in the event you forget your password or you think your password is compromised.
  3. c) We do not have access to any information you enter in any DIY Wills available on our website. Upon completion of this DIY Will, users will be provided with the finalised copy via email or courier delivery (according to prior agreement). After the completion of this process, CFOCORP will not retain any copies of this DIY Will in our servers. 
  4. d) Any data provided by users during the usage of our website will not be retained by our servers after _______ days. We will not be able to provide any copy of any document you generate via our website after the process is completed and you are provided with the finished document.
  5. e) We will only use your data for general purposes aligned with the use of our services, like sending emails related to the services, administrative e-mails, offers, changes in privacy policy, etc. We will not share your email address with advertisers or third parties.
  6. f) We will not share your personal details with any third parties unless it is in the discharge of the services you contracted and with your prior approval. We will also delete all the personal data related to the services you availed from us after a period of ______ days. However, we may add you to a mailing list to send you periodic emails about offers, changes in privacy policy, etc.
  7. g) We do not share this confidential information with third-party organisations unless we are specifically instructed by the user and with prior approval from our users, or unless we are legally obligated under any legislation in force in India. Under this legal obligation, if we are obligated to share your details, we will inform you accordingly, unless we are expressly forbidden under any laws in force in India.
  8. h) We have taken reasonable precautions to protect the data of our users. It is stored on a secure drive. However, we can make no promises for the absolute security of all your data as any security measure taken may not be 100% effective. We also cannot protect you from any third-party sites that you provide your data to voluntarily.

Applicability:

  1. a) We have provided services for succession and estate planning under laws in force in India, including the Indian Succession Act, 1925. Our services are applicable to Indian citizens or people who have properties in India subject to Indian legislation.
  2. b) Although we have provided clauses for different circumstances which could also be applicable to non-resident Indians (NRIs), it is advisable for such consumers to avail offline services to create their own personalized Wills instead of availing the DIY Will format.
  3. c) For any assets owned by an individual outside India, we advise you to create a Will based on that particular country’s legal provisions and requirements by seeking professional legal advice. In the event you utilise any of our DIY services for those assets, the resulting legal complications, if any, will be entirely at your own risk. CFOCORP will not be responsible for the same.
  4. d) We have provided for DIY Wills based on the Hindu Succession Laws. For any consumer practicing Islam, we advise you to seek offline services for succession under Sharia Law.

Changes to services:

  1. a) CFOCORP strives to update our services as soon as required.
  2. b) We try to keep our website updated according to any amendments in legislations in India as speedily as possible. 
  3. c) Having said that, it is not feasible to be on top of every new amendment/ update speedily. Hence, it is possible that the information/ service you seek on our website may not be amended to the latest version. We will not be responsible for any outcome from following any outdated services/ information.
  4. d) The law differs from place to place and different jurisdictions. It is also subject to interpretation by Courts.
  5. e) This website does not offer legal advice or solutions and hence is not guaranteed to be accurate or complete. You are advised to seek our offline legal advice or other professional legal help.

Illicit use of website:

  1. a) You are not allowed to use this website for any manner other than for contracting services from CFOCORP.

Use by customers:

  1. a) CFOCORP grants you a personalised, non-transferable license to utilise the contents and services of this website up to a limited period of time, limited being in the ordinary sense of the word.
  2. b) Your access to this license in no way makes you eligible to modify/ remove/ improve/ change or otherwise affect the contents of this website and the DIY Will making algorithm. You may only bring about change in your personal copy of the Will and any clauses you wish to add/ remove.
  3. c) You also agree that this DIY Will shall be used for your own personal use and benefit and not be redistributed to anyone for any kind of monetary or financial gain without CFOCORP’s express written consent.

Trademark:

The trademarks, images, logos, information, content, service marks and names, graphics, page headers and footers, icons, scripts, are the sole trademarks of CFOCORP. In addition, the name of the website, will.cfocorp.in, is also CFOCORP’s trademark. No one else is eligible to utilise any of our trademarks for any such services or sale of products which is are not created and managed by us, or are not affiliated with us which could lead to confusion between our products and services with such others available in the market among the public, our partners, third parties etc. It shall not be used for any activity which may discredit us or bring disrepute to us. Other trademarks appearing on our website which may belong to any affiliates of CFOCORP, non-affiliates or third parties shall be their own property. We are not conferring any licenses or rights via patents, trademarks, copyrights, and other intellectual property rights via implication, estoppel, etc. to any third parties.

All this content is protected by way of Intellectual Property Rights in India. You are eligible to utilise the contents of this website for the sole purpose mentioned in these Terms of Use. You are prohibited from using this content in any manner which goes against the Terms of Use. The usage of our images, texts, clauses, content, videos, algorithms and software, etc. are absolutely forbidden without the express and written consent of CFOCORP, who is the copyright holder in this instance.

You agree to indemnify CFOCORP and its partners from any damages/ losses/ allegations/ liabilities etc. from third-party claims arising out of any information or data that you voluntarily provided to this website, your use of this website in breach of any regulations and rules mentioned in these terms of use, the infringement of an existing law, regulation or rights etc.

Your account is liable to be restricted/ suspended/ blocked etc. for breach of any rules and regulations mentioned in these terms.

For the resolution of any disputes and claims that may arise out of services provided by us, you agree to the place of adjudication being in Mumbai, Maharashtra, India.

CFOCORP reserves the right to limit the access of this website to any particular geographical location or person at our sole discretion at any point in time.

Any formal communication, which includes the serving of any legal notices that may be required, will be sent to your registered email address in our database. The notice will be deemed to be served 24 hours after the email is sent, unless there is a problem with the email address of the client. Legal notice may also be served upon you by way of courier or postal services, in which case the notice will be deemed to have been served after 3 days of mailing such notice.
